Here are some good ways to determine whether a supplement is being advertised deceptively:

1. Does it promise to cure a disease or ailment?
Dietary supplements cannot legally claim to cure or treat a disease or symptom; only drugs approved by the FDA can. If you purchased a dietary supplement that promised to cure something, you most likely have a case

2. Does it have evidence to back up its claims?
If a supplement is claiming to have an effect without any kind of evidence such as a clinical trial to back that up, it is being marketed deceptively and you may have a case.

Often sold as a “natural” and “safe” stimulant, DMAA was banned as an ingredient in human food products by the US Food and Drug Administration in 2016, but like other common, dangerous ingredients it can still be found in many popular workout and sexual enhancement products today. These amphetamine deratives are not found in nature, are often produced overseas in unsanitary conditions, and are being illegally marketed as dietary ingredients in America.
