Supplement Law

The Facts About Supplements:

The last 20 years have seen an explosion in the market for dietary supplements, fueled by aggressive marketing across social media and across the internet. While most supplements are perfectly safe and can help consumers lead a healthier lifestyle, bad actors in the industry have taken advantage of the booming market to sell remedies with bold claims that have no basis in science, no evidence to support them, and in violation of federal and state consumer protection laws.

As a consumer, you have a right to sue any supplement or drug maker that has deceived you with false claims, and receive compensation for your loss. Kazerouni Law Group is one of the leading consumer law firms in California, and has the expertise needed to hold these illegal marketers responsible. Check the list below to see if your supplements contain a banned ingredient. If you have purchased a supplement that is on this list, use the form below to fill out a confidential case evaluation today- you may be eligible for financial compensation.

We see a range of issues around supplements, but primarily lawsuits in this area fall into two categories: Supplements sold with misleading marketing or labels, and supplements sold with illegal ingredients.

The growth of the supplement industry has created modern-day snake oil salesmen, who are selling remedies with bold claims that have no basis in science, no evidence to support them, and in violation of federal and state consumer protection laws. As a consumer, you have a right to sue any supplement or drug maker that has deceived you with false claims, and receive compensation for your loss. Common false claims include language such as “Prevents X Condition”, “Cures X Illness”, “Lose Weight Instantly”, and more. If you believe a supplement you purchased was sold to you using false or misleading claims, we would be happy to consult with you at no cost. A judge could award you up to $5,000 for your participation in a class action lawsuit against the unscrupulous marketers who sold you the supplement.

Typical false claims include statements such as

“Proven Effective”
“Prevent Panic Attacks”
“Proven To Be Very Effective For Weight Loss”
“A More Natural Way To Cure Diabetes”
“Cures Post Traumatic Stress Disorders”
“Immediate Panic and Anxiety Relief System”
“No Side Effects”
“Reduces Blood Sugar Levels”
“Longer, Harder, Better”
“Reduce Wrinkles!”

Here are some good ways to determine whether a supplement is being advertised deceptively:

1. Does it promise to cure a disease or ailment?
Dietary supplements cannot legally claim to cure or treat a disease or symptom; only drugs approved by the FDA can. If you purchased a dietary supplement that promised to cure something, you most likely have a case

2. Does it have evidence to back up its claims?
If a supplement is claiming to have an effect without any kind of evidence such as a clinical trial to back that up, it is being marketed deceptively and you may have a case.

Some supplement manufacturers not only use misleading marketing to deceive customers, but also use ingredients banned by the FDA. Banned ingredients can often be extremely dangerous to your health, yet are often illegally sold on popular internet shopping sites like Amazon. One such banned ingredient is DMAA. Often sold as a “natural” and “safe” stimulant, DMAA was banned as an ingredient in human food products by the US Food and Drug Administration in 2016, but like other common, dangerous ingredients it can still be found in many popular workout and sexual enhancement products today. These amphetamine deratives are not found in nature, are often produced overseas in unsanitary conditions, and are being illegally marketed as dietary ingredients in America.
