On September 21, 2015, the Honorable Consuelo B. Marshall of the United States District Court, Central District of California issued an Order Denying Dish’s Motion to Transfer the Kazerouni Law Group, APC’s Class Action to Utah. [Read the full Order here]. Therein, Judge Marshall stated that the plaintiff’s “choice of her ‘home forum’ where she resides is ‘entitled to greater deference,’ and weighs against transfer.” [Id. at 4:6-8]. After examining other applicable factors, Judge Marshall ultimately concluded that Dish failed to meet their burden in requesting a transfer to Utah. [Id. at 5:25-27]. The Kazerouni Law Group, APC believes that this is a great Order which ensures that California consumers will continue to have access to Courts in their home state.
