On December 15, 2014, the Honorable Jane L. Johnson of the Superior Court of Los Angeles certified a class action brought by the Kazerouni Law Group, APC against Water and Power Community Credit Union (“WPCCU”). [A true and correct copy of Judge Johnson’s Order may be read here]. In this Action, the Plaintiffs alleged that WPCCU violated the Fair Debt Collection Practices Act, 15 U.S.C. § 1692, et seq. (“FDCPA”); and, the Rosenthal Fair Debt Collection Practices Act, Cal. Civ. Code § 1788, et seq. (“RFDCPA”) due to illegal statements in WPCCU’s collection letters. According to Judge Johnson, Plaintiffs’ class action was a “superior means of resolving the litigation for both the parties and court.” [See page 7 of Judge Johnson’s Order]. Thereafter, Judge Johnson continued to state that such a class action was appropriately certified since “numerous parties suffer[ed] injury of insufficient size to warrant individual action and [] denial of class relief would result in unjust advantage to [WPCCU].” [Id.]. The Kazerouni Law Group, APC believes this is a strong result that will provide relief for more than one hundred California consumers.
