On September 3, 2015, the Honorable Stephen V. Wilson of the United States District Court, Central District of California awarded Summary Judgment in favor of the Kazerouni Law Group, APC and against the Credit Bureau of Santa Maria. [See the full Orderhere]. At issue in this action was the following statement in the Credit Bureau of Santa Maria’s collection letter:
Following briefing and oral argument, Judge Wilson found that the “least sophisticated consumer” could be mislead to believe that a debt collector could not only report nonpayment of the debt, but also [report] the specific reason for nonpayment. [Judge Wilson’s Order, page 3]. Similarly, Judge Wilson also found that the Credit Bureau of Santa Maria’s statement that the consumer did not care about their credit if said consumer did not pay constituted a violation of the Fair Debt Collection Practices Act; and, the Rosenthal Fair Debt Collection Practices Act. [Id.].On these grounds, Judge Wilson granted Summary Judgment in favor of the Kazerouni Law Group, APC. [Id. at page 5].
