LANDLORD TENANT

 

Given the importance to tenants of their place of residence and their place of business and to landlords of their property, landlord-tenant issues can often involve high stakes and high emotions on the part of both parties.  Here at Kazerouni Law Group, we will do our best to diffuse the emotions so that both parties can come to an amicable resolution of the matter.

 

The most common issue that we are faced with is that of landlords wanting to evict their tenants for alleged failure to pay rent, violation of the rental/lease agreement, committing a nuisance, or using the property for an unlawful purpose.  In order for a landlord to be able to evict their tenant based one of the above-stated reasons, the landlord must follow a specific procedure.  The first step is for the landlord to provide written three day notice of eviction to the tenant.  There are specific requirements that the notice of eviction must comply with.  One such requirement is that the notice give the tenant the option to correct the violation.  In the case of failure to pay rent, if the tenant decides to pay the landlord the past due rent and the landlord accepts it, the landlord waives the right to evict the tenant.  If the tenant does not voluntarily move out after the landlord has given proper notice of eviction and the tenant does not remedy the issue, the landlord can evict the tenant. 
 
In order to evict the tenant, the landlord must file an unlawful detainer lawsuit in superior court, which is typically tried and decided within twenty days of the landlord filing the suit.  An unlawful detainer lawsuit consists of the court holding a hearing at which both parties are afforded the opportunity to present evidence and explain their case.  If the court ends up ruling in favor of the landlord, the court will issue a writ of possession, which authorizes the Sherriff to remove and lock out the tenant and seize the tenant’s belongings that remain in the rental unit if the tenant fails to voluntarily leave within five days of being served with the writ.
